Accepting these Terms

Please read these Terms of Service (“Terms”) carefully before using peachcreativesystems.com (the “Site”), which is operated by Fundamentals LLC, doing business as Kelsey Furlong (“Company,” “we,” “us,” “our”), a company registered in California, United States at 3705 W Pico Blvd, Los Angeles, CA 90019. Peach is a studio and brand of Fundamentals LLC.

By accessing or using any content on the Site you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Site.

The Site is intended for users who are at least 18 years old. If you are under 18, you may use the Site only with the involvement and permission of a parent or legal guardian.

Relationship to Our Other Agreements

These Terms govern your use of the Site itself. They do not govern any services we provide to you.

If you engage us for services, that engagement is governed by the separate written agreement or proposal you accept with us. If anything in these Terms conflicts with that agreement with respect to our services, that agreement controls.

Privacy

Your use of the Site is subject to our Privacy Policy at peachcreativesystems.com/privacy, which explains what information we collect through the Site and how we use it.

Site Content Is General Information

The articles, examples, and other content on the Site, including our Insights, are shared for general information and education. They are not professional, legal, financial, or tax advice, and they are not tailored to your business. Acting on anything you read on the Site is your decision and your responsibility. Advice specific to your business is provided only as part of a paid engagement under a separate written agreement.

Booking a Call

You can schedule an introduction call through the Site using a booking calendar operated by a third-party software provider. Booking or attending a call does not create a client relationship or obligate either you or us to enter into an engagement.

Electronic Communications

Visiting the Site, submitting a form, or sending emails to Company constitutes electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications provided electronically to you by Company, via email and on the Site, satisfy any legal requirement that such communications be in writing.

Links to Third Party Sites

The Site may link to other websites (“Linked Sites”). These Linked Sites are not under the control of Company, and Company is not responsible for their contents. Company provides these links as a convenience to you. The links do not constitute endorsement by Company of the site or any association with its operators.

Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site in strict accordance with these Terms. All content included on the Site is the property of Company and is protected by copyright and other laws that protect Company’s intellectual property and proprietary rights. You agree not to modify, publish, transmit, reverse engineer, or create derivative works from content found on the Site. You may share links to our articles and quote brief excerpts with attribution. You do not have, and will not have, any ownership rights in any protected content, and Company does not grant you any licenses, express or implied, to its intellectual property except as expressly authorized by these Terms.

Prohibited Uses

You agree that you will not, and will not permit anyone acting on your behalf to:

  • use the Site for any unlawful purpose or in violation of any applicable law or regulation;
  • copy, scrape, harvest, index, or otherwise collect content or data from the Site by automated means, including by using any robot, spider, crawler, or data-mining tool, except for search engines operating in accordance with our published robots file;
  • attempt to gain unauthorized access to the Site or any system or network connected to it, or bypass any security or access-control measure;
  • interfere with or disrupt the Site or the servers or networks that host it, including by introducing malware, viruses, or other harmful code, or by imposing an unreasonable load on our infrastructure;
  • submit false information, spam, or unsolicited commercial messages through any form or booking calendar on the Site;
  • impersonate any person or entity, or misrepresent your affiliation with any person or entity, including with us;
  • use any content from the Site to train, fine-tune, or otherwise develop any machine learning or artificial intelligence model without our prior written permission; or
  • use the Site in any way that could damage, disable, overburden, or impair it, or interfere with any other party’s use of the Site.

We may investigate any suspected violation of this section and may involve and cooperate with law enforcement authorities.

Indemnification

You agree to indemnify, defend, and hold harmless Company, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses relating to or arising out of your use of the Site or your violation of these Terms.

Dispute Resolution

You and Company agree that any dispute or claim arising from or relating to these Terms or the Site shall be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will take place in Los Angeles County, California, and judgment on the award may be entered in any court having jurisdiction.

You and Company agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding.

Either party may bring an individual claim in small claims court instead of arbitration, so long as the claim remains in that court and is brought on an individual basis. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights.

Liability Disclaimer

The Site and all content on it are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

The information and content on the Site may include inaccuracies or typographical errors, and Company may change it at any time. Company makes no representations about the suitability, reliability, timeliness, or accuracy of the information on the Site. To the maximum extent permitted by applicable law, in no event shall Company be liable for any direct, indirect, punitive, incidental, special, consequential, or other damages arising out of or relating to your use of the Site.

International Users

Company is owned and operated in the United States. If you access the Site from outside the United States, you are responsible for compliance with your local laws.

Access Restriction

Company reserves the right, in its sole discretion, to terminate your access to the Site at any time without notice.

Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules, and the laws of the United States of America.

Entire Agreement

These Terms constitute the entire agreement between you and Company with respect to the Site and supersede all prior or contemporaneous communications between you and Company about the Site.

Severability

If any part of these Terms is determined to be invalid or unenforceable, the rest of these Terms shall remain enforceable, and the invalid portion will be deemed replaced by a valid, enforceable provision that most closely matches the intent of the original provision.

Changes to these Terms

Company may change these Terms at any time. When we do, we will post the revised Terms on this page and update the “Last updated” date above. The most current version supersedes all previous versions, and your continued use of the Site after a change is posted means you accept the revised Terms.
